On February 1st, 2023, the second phase of the Zimbabwe Integrated Electronic Case Management System (IECMS) was piloted in the Labour and Administrative Courts of Zimbabwe. Henceforth, the filing of the applications, review and case processing including hearings at the two judicial institutions will be fully done electronically.

It will also allow both the general public and legal professionals to obtain court rulings, monitor the progression of cases through the system, submit case-related documents electronically, and make payments for court fees online.

Prior to the official launch, Synergy eJustice team delivered training to the court staff and other system users to familiarize them with the new system.

The second phase was built on the success of the initial pilot of IECMS in May 2022 that covered the digitalization of Constitutional Court, Supreme Court, and the Commercial Division of the High Court of the country.

It is expected to pave the way for a nationwide roll-out of the system by the end of 2023, with the goal of transforming the entire legal system in Zimbabwe, improve the efficiency and transparency and enhance access to justice for citizens.

What is people-centred justice?

People-centred justice is an approach to international justice that shifts the focus from court rules, procedures, and processes to a results-based focus placing people, families, and communities at the centre of justice service delivery. This requires court administrators to go beyond identifying operational improvements that work best for them, and identify what strategies, activities, and processes produce the best results for the people they serve.

There is today no longer much doubt whether good measures and indicators of court performance can help achieve worthy ends. The question is whose vision of justice and court excellence they advance. Performance standards and measures for courts are meaningless if they are detached from the people they are intended to represent. Though they may be grounded in historical understanding, democratic vision, and civic ideals, government performance measures are traditionally developed from the perspectives of government managers, not of citizens, and the two perspectives may differ greatly.

How Rwanda achieves this?

Rwanda is a regional leader in people-centered justice, with a strong and developing culture of Performance Measurement and Management. This has been achieved through a strategic planning process based on country vision, international standards, and the expectations of the Rwandan people. It has been enabled through the implementation of advanced technology for data collection, analysis, and reporting, as well as a learning culture that quickly adapts and applies lessons learned.

In the article, the authors identify key approaches, based on their experience in Rwanda and elsewhere, that will align the practice of court performance measurement and management with the values and principles of people-centred justice.

Synergy Launches Work on Forensic Case Management System in Moldova

In April 2022, Synergy began work on the design and development of a Forensic Case Management System (FCMS) for the national forensic institutions in the Republic of Moldova, including the National Centre for Judicial Expertise, Police Forensic Centre and Centre of Legal Medicine. The work is carried out in close coordination with the Ministry of Justice of the Republic of Moldova, Electronic Governance Agency, and Information Technology and Cyber Security Service.

The system will digitize the business processes of the forensic institutions, helping to improve the record-keeping process and ensure proper custody of forensic evidence. Functionally, the system will allow the forensic institution’s key personnel to digitally open an evidence case, enter relevant information about the evidence (including documents and photos) in the case file, and distribute the case for cross-verification and acceptance. 

Following the inception mission to Chisinau, Moldova, Synergy is currently in the system design phase, working in tandem with the Ministry of Justice and UNDP Moldova. Synergy has also partnered with Enterprise Business Solutions, a Moldovan technology firm, to help provide local implementation support to the project.

The activity is implemented within the “Strengthening Efficiency and Access to Justice in Moldova” Project implemented by the United Nations Development Programme (UNDP) with the financial support of Sweden.

The objective of the A2J Project is to contribute to increased efficiency of justice services and to improved access to justice for men and women, in particular from vulnerable and marginalized groups through enhanced capacities of forensic institutions to provide qualitative justice services, strengthened capacities of the justice sector actors to provide a coordinated response to men’s and women’s justice needs, as well as a strengthened civil society able to claim the respect of rights and engage in a constructive dialogue with the justice chain actors at the local level.

Synergy Begins Work on National eCase System in Ethiopia

Synergy has started work on the design and development of an Integrated Case Management Information System (iCMIS) and Electronic Records Management System (eRMS) for the Federal Courts of Ethiopia.  The project is being executed under the USAID/Ethiopia Feteh (Justice) Activity, with prime implementing partner Millennium DPI.  The Feteh Activity has the goal of building the capacity of Federal and Regional Supreme Courts’ personnel to implement judicial reforms consistent with international human rights standards and to introduce international best practice systems to improve court administration and case management.

The iCMIS and eRMS will be co-designed and developed over the next several months and piloted in the Supreme Court and seven High Courts, before a full national federal court rollout by the end of 2023.

Following the successful kick-off meeting with all key project stakeholders, including Millennium DPI (Feteh Activity Prime Contractor), Perago Systems (Synergy’s local partner), Digifinance (Feteh Activity Subcontractor), and the Federal Courts of Ethiopia, the Synergy team travelled to Addis Ababa for the inception mission which was used as an opportunity to refine the scope and priorities of the project.

Synergy Digitalizes the Jail System in Jamaica

Synergy has been awarded a contract to implement a Jail Management System (JMS) for the Government of Jamaica. The JMS is supported by the Inter-American Development Bank and will support the Department of Correctional Services under the Ministry of National Security. Synergy has partnered with PricewaterhouseCoopers who will provide local project administration, systems analysis and change management.

This project fits within the Ministry of National Security’s Five-Pillar Strategy for Crime Prevention and Citizen Security. The JMS will support the overall mission of DCS to contribute to a better society by effectively securing and transforming offenders for successful reintegration, thus helping Jamaica to serve as the Caribbean Centre of Excellence in Correctional Management. The JMS will provide a single source of truth to 17 probation offices, 7 adult correctional centres, and 4 juvenile centres.

MonitoringDesigning Systems to Support Judicial Reform for the European Court of Human Rights in Armenia

Synergy will design and develop the Integrated Office Management (IOM) system for the Office The Representative of the Republic of Armenia. The project aims to support Armenia in the execution of ECtHR judgments in which violations of Article 6 of the Convention are established. The major groups of such judgments include improvement of access to justice, prevention of the non-execution or delayed execution of judgments of national courts, and development of remedies concerning excessive length of judicial proceedings.

In October 2021, the Judiciary of Uganda officially commissioned the Electronic Court Case Management Information System (EECMIS), a solution built from Synergy’s eCase product.

From 2019-2021, Synergy has been working to design, develop, and roll-out the system in close collaboration with the Judiciary. The system digitizes all aspects of case management, starting at registration, proceeding through case assignment, hearing, and judgement, and provides a full suite of analytical features and online auction.

Synergy’s Vice President Adam Watson attended the launch of the EECMIS. The system will also reduce contact between the litigating public and court staff, thus supporting an independent judiciary and justice sector.  Starting in early 2022, the system will be piloted in 18 courts around the country including the Magistrates Court, Court of Appeal, and Supreme Court.

Chief Justice Alfonse Owiny Dollo hosted the official commissioning of the EECMIS and said at the launch event:

 

“This (ECCMIS) will definitely provide a major building block to another e-government service in Uganda and particularly to the administration of the justice sector and will go a long way in enhancing the delivery of justice and addressing the challenges of case backlog.”

Senior officials of Zimbabwe’s Judicial Service Commission and Synergy executives have launched a digitization project to strengthen digital readiness and enhance access to justice for all.

The collaborative framework was finalized during the visit to Yerevan, Armenia by the delegation led by the Honorable Chief Justice of Zimbabwe, Mr. Luke Malaba. The other delegates included Mr. Walter T. Chikwana, Secretary of the Judicial Service Commission, Mr. Milton Shadaya, Head of Financial Services, and Mr. Obey Manyenga, Head of IT and Records Management from the Judicial Service Commission.

“We are delighted to be in this country on a working visit at Synergy International Systems. We have been received well, and we are gratified with the warm welcome, reception and hospitality extended to us by our hosts in particular and the Armenian people in general. We have gone into a partnership with Synergy for them to develop and implement an Integrated Electronic Case Management System for the judiciary in Zimbabwe,” said the Chief Justice of Zimbabwe, the Honorable Mr. Luke Malaba.

“We want a system that guarantees the efficiency and effectiveness of the courts in Zimbabwe. We have held fruitful meetings with the leadership of the company and their technical personnel. We are happy with the progress made so far and cannot wait to have the system installed at our courts,” the Chief Justice of Zimbabwe added.

At the Yerevan office, the mission participants got first-hand information on the project implementation approach, reviewed change management recommendations and lessons learned, as well as discussed and signed the system design document.

“We are happy to support the Judicial Service Commission in its mission to build a more accessible, responsive and resilient Judiciary. Leveraging the power of technology and expertise that Synergy delivers, Zimbabwe will make accessing the judiciary safer, easier, and more affordable amid the COVID-19 pandemic and beyond,” said Dr. Ashot Hovanesian, CEO and Founder of Synergy International Systems, Inc.

Within the modernization project, Synergy will provide Zimbabwe with a software solution that will integrate the Constitutional Court, Supreme Court, Commercial Court, High Court, Labor Court, Administrative Court, Magistrates Court, Master of High Court and Sheriff of the High Court under one tech umbrella. The solution will help automate and track the entire case lifecycle, from initial filing through disposition and appeal.

Synergy partners with Zimbabwe’s Judicial Service Commission to start the digital transformation of the country’s judiciary enhancing access to justice for all.

Synergy International Systems and Zimbabwe’s Judicial Service Commission will work together to promote the adoption of new technologies and skills development across the judiciary and law society. Synergy, as the technology provider, will design and implement an integrated case management system to support the Judicial Service Commission in its mission to become paperless.

In December 2020, the Judicial Service Commission involved Synergy as a technology partner in an attempt to provide a more accessible and digitized public service and improve easy communication between the judiciary and public.

For years, Zimbabwe has lacked an all-encompassing case management platform that could reflect existing processes, interact with related systems and be reliably accessible. This has hindered the effective processing and resolution of cases in a timely manner. Today, there are few tools for real-time analysis and monitoring of performance, as well as for case processing, which is a barrier to evidence-based decision-making. Furthermore, the COVID-19 pandemic has brought to the fore the need for accelerating the digital transformation of the judiciary in Zimbabwe. It has become obvious that citizens and businesses must have access to justice also online. Officially opening the 2021 legal year on January 11, Zimbabwe’s Chief Justice Luke Malaba said that:

 “Courts could not afford to lag behind in harnessing the potential of ICT in ensuring that access to justice is not disrupted.”

Within the modernization project, Synergy will provide Zimbabwe with a software solution that will integrate the Constitutional Court, Supreme Court, Commercial Court, High Court, Labor Court, Administrative Court, Magistrates Court, Master of High Court and Sheriff of the High Court under one tech umbrella. The solution will help automate and track the entire case lifecycle, from initial filing through disposition and appeal.

During the upcoming years, Synergy will work closely with the Judicial Service Commission in multiple directions:

Digitization: Synergy will help optimize and improve processes using technologies and best practices. This means that Zimbabwe’s judiciary will be able to gradually go paperless reducing case backlog, speeding up case disposition, improving the quality of case adjudication processes. Parallelly, citizens and businesses will have access to justice, from their laptop at home.

Capacity Building: Synergy will also develop a dedicated training program. Along with the technology solution, Synergy will provide both court staff and technical teams with knowledge that will make them more effective and sustainable.

Response to COVID-19: The pandemic exposes a dire need to enhance communication across all possible channels. Synergy will make virtual collaboration technology available to allow better interaction between the judiciary and the public.

Data Collection: Through the integrated case management, platform users will be able to collect and manage consolidated case-specific data, ensure effective case processing, including fee payments and overall court performance, and enhance the transparency and accountability. The new real-time analytic tools will help improve the quality of strategic decisions.

The COVID-19 pandemic underscores the urgency of transforming justice systems and delivering public services online. Having begun the journey of digital transformation of court cases more than five years ago, the justice sector of Rwanda no longer relies on manual, paper-based case processes. The Judiciary’s use of an online case management solution has kept the courts, as well as other agencies, functioning during the COVID-19 pandemic and has supported the goal of making the justice system more accessible and efficient. 

Rwanda entered full lockdown on March 16, 2020 after the first case of COVID-19 was identified in the country. Restrictions were in place until May 31, 2020 during which all institutions, including the Judiciary, were prohibited from opening to the public and had to find innovative ways to sustain service delivery. Because the Judiciary of Rwanda had invested in the Rwanda Integrated Electronic Case Management System (IECMS), adapting to the new reality was significantly streamlined. The IECMS served as the backbone for facilitating case filing and follow-up, including case registration, adjudication, and judgment execution, as well as new features for online auctioning.

During the total lockdown, litigants continued to file and follow up on claims and cases online through the IECMS. Over 14,637 cases were filed in court during the total lockdown from March 16 – May 31, as compared with the first months of 2020 (pre-lockdown from January 1 – March 15) when the total number of filed cases was around 21,015.

Amid the outbreak of the COVID-19 Coronavirus, both private and governmental law and justice operations are being negatively impacted. Countries and states are forced into quarantine and are adapting their methods of citizen engagement, looking for ways to continue to provide services to the public and not suspend their entire operations.

It is in extreme situations and crisis circumstances such as this, when face to face interactions are limited (or in some cases even prohibited), that the power of technology can be appreciated from a new perspective. While electronic Case Management Systems were originally designed to help governments improve efficiency and combat corruption, in times of crisis the systems display their full value: they support continuity in electronic business processes, enabling social distancing for a subset of their operations that otherwise would have been suspended.

As courts and other justice institutions worldwide are trying to identify new ways to continue their operations, the ones who are already employing electronic Case Management Systems have the option of not shutting down their institutions entirely. Even though some operations are being halted, for instance case hearings and pre-trial meetings, governments that have invested in these systems are now reaping their unforeseen benefits. Those courts and other justice institutions that have moved their services online are able to maintain a base level of functioning and can continue reaching out to their citizens.

Case in Point: E-filing within Rwanda IECMS

Launched in 2016, the Rwanda Integrated Electronic Case Management System (IECMS) integrates all institutions of the country’s justice sector (Rwanda Investigation Bureau, National Public Prosecution Authority, Judiciary, Rwanda Correctional Services, etc.). Since then, all case related business processes of the country’s justice sector have been conducted electronically.

One such business process is the filing of court cases. Since 2016, all cases in Rwanda have been filed electronically, thus eliminating the need for citizens to visit the court in person to file their cases.

In light of the current situation, Rwanda IECMS is helping justice institutions in Rwanda to achieve more than simply increasing their efficiency.

In a “Notice to the General Public” on measures taken to prevent and combat the spread of COVID-19, issued by the Supreme Court of Rwanda on March 15, 2020, the Bureau of the High Council of the Judiciary orders “the suspension of court hearings, pre-trial hearings and scheduled meetings between litigants, court administration and the Department of Inspectorate of Courts” for a period of two weeks, until March 30, 2020. The official statement advises the litigants and the general public to contact courts through online platforms and hotlines, including IECMS.

Rwanda IECMS is helping Rwandan courts not to close down entirely. The system continues to provide an interface between the Rwandan Judiciary and litigants for electronic filing of cases, which allows the registrars to receive new cases from litigants. Moreover, judges continue to have remote access to their cases, making judicial and court services accessible to citizens even in times like these.

“Rwanda IECMS is vital in situations like the one we are facing now, because it enables judges and Court officers to work remotely on their cases from anywhere,” says Justice Harrison Mutabazi, the Official Spokesperson of the Rwanda Judiciary.

The remote access to justice is also helping the Government of Rwanda to prevent the spread of COVID 19 by physical contact.

“In such situations, e-filing is very helpful, since it aids the litigants to file their cases to the Court without necessarily approaching in person. This reduces physical contacts between litigants to litigants and to the Court officers. I think this is one of the means helping to curb the spread of the scourge,” says Justice Harrison Mutabazi.

Moreover, Rwanda IECMS enables electronic transmission of relevant information between various institutions of the justice sector, from the Rwanda Investigation Bureau to the prosecution, then courts and correctional services. Initially designed to increase transparency and efficiency, this functionality of the IECMS is now contributing to the continuity of some segments of the sector, while preventing any sort of physical contact.
